Intellectual property disclaimer

I. Scope of Application

This Disclaimer applies to all decorative painting products displayed and sold on this website/store (hereinafter referred to as "the Platform"), including but not limited to printed paintings, hand-painted artworks, digital art reproductions, framed paintings, and related derivative products (hereinafter referred to as "Products").

II. Intellectual Property Statements

1. Original Works: Products labeled as "Original Design" are owned by the Platform or collaborating artists. Without prior written authorization, no entity or individual may copy, distribute, modify, or use such works for commercial purposes.

2. Licensed Works: Certain products are produced based on IP characters, artworks, or photographs for which legitimate licenses have been obtained. The Platform warrants that licensing agreements with rights holders have been executed within the authorized scope, and the licensing chain is complete and verifiable.

3. Public Domain and Lawfully Sourced Materials: Some products incorporate materials sourced from the public domain, royalty-free image libraries, or platforms with purchased commercial licenses. The Platform exercises reasonable diligence to verify the licensing status of such materials but does not provide unlimited warranties regarding the absolute accuracy of original rights ownership.

III. Disclaimer

1. Third-Party Claims: Should any Product give rise to a third-party intellectual property claim, the Platform will promptly remove the relevant Product upon receiving valid notice and cooperate by providing licensing documentation. The Platform shall not be liable for punitive damages regarding rights defects that could not reasonably have been foreseen despite the exercise of reasonable review.

2. User-Generated Custom Content: For images, texts, and other materials provided by users through the Platform's customization service, the user warrants that they hold the necessary intellectual property rights. The user shall solely bear all legal liabilities and damages arising from any infringement of third-party intellectual property rights caused by the provided materials. The Platform assumes no liability.

3. Scope of Permitted Use: Products on the Platform are for personal decoration, appreciation, and non-commercial use only. Purchasers may not use the Products for large-scale commercial reproduction, resale, or profit-making derivative works. Any intellectual property disputes arising therefrom shall be borne solely by the purchaser.

4. Technical Limitations: Due to technical limitations such as digital watermarking and screenshot capture, the Platform cannot completely prevent unauthorized scraping or dissemination of product images. The Platform will pursue legal action against infringers but shall not be held liable for dissemination consequences resulting from the purchaser's own disclosure.
